Rightsholder Options: Evaluating Rights & Licensing in an Exploding Cross Platform Distribution Universe
While "Content is King," it is also under continual attack and strain within the exploding multi-platform universe. As we move further into a world of mobile, broadband, DVD, cable, satellite and telco, information on demand and interactive advertising, keeping track of, evaluating or finally licensing or reaching agreement on how rights are to be assigned and revenue shared is not only challenging, it is a thorny and time consuming problem. In this session, we bring together experts who are intimately involved in the day to day issues addressing the rightsholder dilemma. We live in a world of extremes, from those that represent the disruptive technologies who at the least threaten or confound the rightsholder to the content owner, creator or producer who are trying to come to grips with their options and responsibilities.

Mr. Jørgen Blomqvist, a national of Denmark, is Director, Copyright Law Division, of the World Intellectual Property Organization (WIPO), Geneva. He holds the degrees of Master of Laws and Ph.D. from the University of Copenhagen. Before joining WIPO in 1992 he was Legal Counsel and Assistant General Manager of KODA, the Danish Performing Rights Society; Research Fellow at the University of Copenhagen; and Head of Section in the Danish Ministry of Cultural Affairs. In 1992, he joined WIPO as Senior Legal Officer. His present responsibilities include WIPO’s activities regarding progressive development of international copyright and related rights, promotion and implementation of copyright and related rights treaties administered by WIPO, legal advice to developing countries and copyright legal issues relating to territoriality and private international law. He has published a thesis on Transfer of Copyright Ownership and several articles on various issues relating to copyright and related rights.






Jim Ryan, Senior Vice President and General Manager, EMEA, Macrovision Corporation: As senior vice president and general manager, EMEA, Jim Ryan is chartered with leading Macrovision's EMEA organization and aligning its revenues with Macrovision's vision and expectations for the global sales team. Prior to his current role, Ryan led Macrovision's services organization as well as its support, operations and pre-sales teams. Prior to joining Macrovision, Ryan was senior vice president of international sales and operations for InstallShield Software Corporation. He joined InstallShield from Reliant Data Systems, now Compuware Corporation, where he was a regional sales director with responsibilities for both traditional direct sales channels as well as OEM sales. Prior to Reliant, Ryan was director of channel sales at Unison Software, now Tivoli Systems, where he spearheaded the channel program for its distributed systems management solutions group. Additionally, Ryan has held positions at Lakeview Technology and IBM Corporation. Ryan earned a Bachelor of Arts from Marquette University where he studied International Political Science and French.

Robert Schumann, General Manager, Cinea: Mr. Schumann's expertise in building innovative security businesses has enabled Cinea to position itself for leadership. As General Manager, he leverages his 17 years of technology security experience to drive Cinea towards its continuing mission of providing world-class anti-piracy solutions for the entertainment industry. Prior to co-founding Cinea in 1999, Mr. Schumann was chief architect for the Divx encrypted DVD platform. Beginning in 1994, Mr. Schumann spearheaded the development, deployment and operation of this leading-edge consumer system. Mr. Schumann also directed planning for international expansion and the exploitation of Divx technology in new markets. Earlier in his career, Mr. Schumann was a senior IT executive at Circuit City Stores, Inc., where he spent over seven years deploying sophisticated secure telecommunication, transaction processing and customer support technologies. Mr. Schumann has a Bachelor’s degree in Computer Science from the Rochester Institute of Technology.

Marla Shapiro is a Director at the MCPS-PRS Alliance. In this role, she is responsible for creating and maintaining standard licensing approaches for the broadcast and online markets, with a particular emphasis on analysing new, digital business models. Prior to joining the Alliance, Marla worked for the Financial Times in New York City as the Director for Business Development for FT.com - US. She led efforts to form strategic partnerships designed to drive online revenue and support the growth of the FT brand in the States. Before working directly in the media sector, Marla worked for a number of years in London and New York City as a banker at National Westminster Bank and JPMorgan in a variety of structured finance roles providing service to the utilities and media/technology sectors. Marla holds an MBA in Finance from the Massachusetts Institute of Technology.




Peter Kang is a Partner in the San Francisco office of the global law firm of Sidley Austin Brown & Wood LLP. Mr. Kang joined Sidley’s Intellectual Property practice group in 2003 (ranked in the top 3 nationwide by American Lawyer magazine), devoted to serving the IP and related legal services needs of technology clients. Mr. Kang counsels clients in patent disputes; technology transfer and IP licensing; strategic IP portfolio development; patent opinions; and IP enforcement and litigation. Mr. Kang has served as an advisor to iPark (formerly known as the Korean Software Incubator), and is an International Advisor for Global Venture Consultants. Mr. Kang is registered to practice before the U.S. Patent and Trademark Office, and is a member of the California bar. Mr. Kang works with Fortune 100 electronics companies, software and Internet companies, and content/game developers in IP matters worldwide. Mr. Kang has also advised independent film directors/writers, artists, and novelists in copyright/trademark issues and related content-licensing matters. In addition, Mr. Kang is an experienced IP trial attorney, having represented clients in complex litigation and trials of IP lawsuits nationwide, including federal court patent jury trial experience and patent trial experience before the International Trade Commission. With over a dozen years’ experience in Silicon Valley, Mr. Kang has represented ecommerce ventures, online startups, independent software consultants, game developers (including MMORPG, traditional arcade games, and hardware developers), electronic mapping and software navigation developers, and gaming companies. Prior to joining the Firm, Mr. Kang was Managing Partner of the San Francisco Office of a nationally recognized IP boutique. Earlier in his career, Mr. Kang served as Law Clerk for the Hon. Ernest C. Torres, now Chief Judge of the U.S. District Court for the District of Rhode Island. Prior to law school, Mr. Kang worked as a software engineer for a biomedical research organization at Brown University. Mr. Kang served on the Board of Directors of the Asian Pacific Bar Association of Silicon Valley, and is a regional governor of the International Association of Korean Lawyers. He is an award-winning author and frequent speaker at industry and legal conferences. He received both a B.A. in Classics and a B.S. in Industrial Engineering from Stanford University, where he won both the Fairclough Award and the Classics Department Senior Prize. Mr. Kang also received a Certificate of Merit from the University of London’s Institut Brittanique in Paris. Mr. Kang received his J.D., cum laude, from Georgetown University. Lucy Beard, Solicitor, Denton Wilde Sapte: Lucy is a solicitor in the media group of the Technology, Media and Telecoms (TMT) department at Denton Wilde Sapte. Denton Wilde Sapte is a leading international law firm, which comprises a team of specialists dedicated to the TMT sector. Lucy specialises in a mixture of regulatory, commercial and corporate work for a wide variety of clients in the media and new media sectors. Clients range from large corporates to new market entrants, and Lucy has a particular focus on new media services such as mobile television.
